You missed her point entirely.
She was saying that it likely did happen, but not because of "telemarketing" (so the "do not call" list wouldn't matter) . . . most likely, she gave the cell # out as part of some promotion, or in a 'fishbowl' giveaway, or signing up for something. This means she can be called, generally, because it's outlined in the fine print - so yeah. No case, no "do not call" list will matter, and no one else was using her phone.
