Did some brief research, while maybe not totally on point, there is a recognized rule in several jurisdictions that ballpark attendees assume some risk of being hit by an errant ball.

I'm assuming the husband is suing because he can't have sex with his wife? What does her getting hit in the face have to do with sex?
