I think fine dining should do it if they want to. If family business is important enough to them that they want to accommodate kids then great, otherwise they also have the right to set rules about not allowing kids in under a certain age, or simply not making it easier for toddlers by not having high chairs or something. Someone who is annoyed by kids can choose their restaurants based on this policy. (Unlike cigarette smoke, loud noise doesn't cause health problems, it just pisses you off.)

Most kids don't turn into squalling brats at the drop of a hat, and good parents will have a plan for that if it does happen. But hell, if you can afford to eat really well even as a parent, I'm not going to stop you.
