No, I'm torn because of my education. While criminals should be punished, they should also be treated. Some people can indeed be rehabilitated. So my emotional side says kill the bastards and my intellectual side acknowledges that it isn't so simple.

Because he says she consented and she says she didn't. Semen is proof of intercourse, not proof of rape. And say they're both drunk off their asses, who was raped? The aggressor? Both of them?

Sentences vary a LOT depending on what state you're in and the type of offense and prior history. I'm pretty sure Probation is potentially an option in some areas, mandated therapy can be done in conjunction with jail time.

Most people are reluctant to charge an alleged rape victim with perjury because it IS possible it happened but couldn't be proved. But it's becoming more common if it's clear she lied.

I think a thief that maybe might have stolen something that didn't belong to him/her should get another chance after serving about 15-20 years.

Someone that has physically hurt another individual should be locked up for life. Period. Especially if it's rape, or murder that serves no purpose.

He shouldn't have been drunk. He should have been more responsible. Her too. Plus, they can tell if there was forced penetration. I just think things should be cut and dry, black and white. None of this grey area stuff. I would suck as an attorney.

ok here's me trying to bring this convo full circle, since this thread is being claimed as a "train wreck"

the purpose of the woman who created this product seemed to have this is mind - making the woman a little more "responsible" for being in a situation where she may be raped. thing is, ANY time is the time for a woman to be taken advantage of and furthermore its not like a woman is 100% helpless in said scenario. like its been mentioned, its never a woman's fault that she is raped but she CAN take preventative measures to minimize the chances of it happening. that doesn't mean "hey go ahead and walk down that dark alley half-tipsy with fishnets and a short skirt with that sketchy guy you met at the bar" but it does mean "sure you can wear that skirt if you want but understand the kind of attention (warranted or not) you will attract. and sure, go home with that guy, but think long and hard first - is this something youre gonna regret in the morning? does this guy pose a risk to my safety? do i have a plan B if something goes down that i dont like?"

now does living in a continuous state of paranoia and wearing a plastic d*ck clamp (which i see as an emotional and physical hassle, as well as a potential health risk, thought the site says there arent any and a financial burden, as it can get costly) everyday solve the problem of the hundreds of rapes that happen on a daily basis? hell no. does it attempt to give some power to the women who are caught in this scenario? yes. does it do it well? not so much.

You kind of acknowledged my point and then missed it. When there's hard evidence it's much easier to convict (though of course sometimes women and men are extremely vindictive and will decide after consensual sex that they 'changed' their mind.)

If the case is just a testimony, it's more difficult to prosecute. If the DNA is there it's not really a he said she said case anymore.
Also, working with prisoners on a regular basis in my job, I have to come into contact with these assholes all the time. I hate it. Medium security is worse than max because medium will have more child molestors and rapists. This is because they get moved down a level due to good behaviour. We get some real scumbags occasionally. The guards will tell us what's up with each inmate.

PrettyBoy, locking people up for life if they hurt someone else sounds fine and dandy but good luck finding the money or the space for it. Nothing is that simple.

Actually I'm an EMT but we go to the local correctional facilities to get inmates and bring them to hospitals in Boston. Some of the inmates are so nice that you forget that they're in there for a reason, occasionally a really horrible one. I've never been threatened, but I'm pretty sure I've been checked out quite a few times.

Agreed. There's no telling what a rapist with some painful contraption stuck to his penis and possibly a knife or gun might do to you.

Any self-defense device has to be enough to stop your attacker long enough for you to get away. I'll stick to my stun gun & pepper spray, thanks.
