If they sue for it, they can get it back, but it depends on the state. AND assuming they kept some kind of paper record of what was paid when, etc. An oral agreement can be hard to prove. Some states say if you sign the birth certificate then you are legally the father unless DNA proves otherwise. Here in VA, paternity can be established via marriage, so if mom marries the boyfriend and he is not her child's father, he's legally and financially responsible for his step child if he and the mother break up. (Confused?)
And if people would stop having sex with out protection, that would reduce paternity fraud as well.
