Fraternity sues sorority

Lawsuit alleges group didn't maintain leased house

A vacant Kansas University fraternity house needs roughly $850,000 in mold remediation and mechanical repairs, according to a lawsuit filed in Douglas County District Court.

The subject of the suit is the Lambda Chi Alpha house at 1510 Sigma Nu Place, which the fraternity began leasing in 2000 from Alpha Omicron Pi, a Tennessee-based sorority no longer active at KU. The lawsuit, filed earlier this month, alleges the sorority violated the contract by not properly maintaining the house.

The fraternity wants to exercise an option to buy the house, then demolish it and build a new one on the site, but the suit alleges the sorority kept the sale from happening by failing to get an appraisal required by the contract.

"We were forced into the situation, and when you don't have any recourse, then you have to file suit in order to get the other party to comply," said fraternity alumnus Bruce Wanamaker of Overland Park, treasurer of the corporation that oversees the house.

Fraternity members moved out of the house at the end of last year, Wanamaker said. This year, they're living together at an off-campus apartment building.

The main priority for the fraternity is to get the sale of the house under way so work on the site can begin, said Chris Burger, Lambda Chi Alpha's attorney. The suit asks a judge to require the sorority to sell the house for the amount of the fraternity's appraisal or to force the sorority to get its own appraisal, as required by the lease.

The fraternity also wants its deposit back and enough money to fix the house's problems.

Officials at Alpha Omicron Pi headquarters in Brentwood, Tenn. referred questions to their attorney, who could not be reached for comment last week.

Wow that's really sad. A very good friend of mine is a Lambda Chi at KU. I hope everything works out for the best!

Arya,

thank you for posting this. I new they had to move out because of a extremely bad mold situation. I have been in the House a couple of times and something just didnt seem right. Musty smell all through the Room wing.

To give you a concept of where the house
is:

On a cul du sac, across from the SN house. AGD owns the land and wants to build if they can get all of the permit, rule, and regulation crap out of the way!

I am in hopes that the Brothers can get the situation resolved.

GLO sues other GLO. lol Don't GLO's get sued enough? I understand where LXA is coming from. If AOPi broke the lease they are responcible for it.

This one doesn't sound like they're seeking punative damages or anything more than a judge to force the sorority's house corporation to comply with the contract they signed. Surprising to see that the sorority's housing corp is being so uncooperative. I'm sure their side of the story is compelling.

Okay, I'm confused. If AGD owns the land, why was the AOPi house on it? Was there an AGD house that turned into an AOPi house?

AOPi owns the actual house, LXA leases the house from AOPi House Assoc.
According to the suit AOPi would not get an appraisal on the said structure, which LXA wants to buy-tear down-and rebuild (land is at a premium). House has serious mold issues, therefore LXA cannot occupy the house.

AGD is the neighboring property. The current AGD house is across campus-- but owns the property next to the house involved in the suit.

Thank you for spelling out my Fupa. Mind works , fingers just cant keep up with it!

Still dont understand why at that spot there tho! Hell is a Black Ski slope in Co. But nice it will be next door to the LXA House I hope!

I think they are living just down the street in the old DTD house.

Thanks ZEKE, that is the crux of the problem! They are not keeping up the part of the bargin! Iknow that we do want that as Land at U. Ks. is really at a premium and especially that close to campus!

U. Ks is built on Hills, and I do mean Hills. Hell, if got enough snow there would make a great ski resort!

AGD did get approval to build their new house a couple of months ago!!! It was a tough fight for them, and a close vote. But the approval did come through.
