Don't think so... if the rat-f*cking bastard is military and committed it inside of a military reservation, he would fall under the UCMJ (Uniform Code of Military Justice) and federal law.
He's lucky the police caught him... I can imagine the lynch mob gathering with a rope and a few kegs of beer...
