I think what he meant was the Federal death penalty is one of the least-used. Last execution I recall the Feds doing was Timothy McVeigh back in 2001.

The federal gov't may not prosecute/impose the death penalty often, but I will make you a bet... there is a hell of a better chance of getting it with a federal prosecution than either state. I bet a whole lot of death penalty opponents in ND & MN are at least rethinking their stance.
