Definitely - the brothers are all responsible for support of each other, and should have never allowed something like this to happen. The basis of the organization is for mutual betterment of the men involved, I'm sure. It will be interesting to see, though, how this works out in court - the responsibility to protect each other lies in fraternal vows etc, not necessarily legal liability.

To put it like this - if the student wasn't greek, and got smashed at a buddy's house and died in a similar way, would the friends be legally liable?

Either way - it's an awful thing for everyone involved to need to deal with.
