eBay/Ticket Scalping

I think we touched on this briefly in another thread awhile ago, but I don't think the question was ever answered: We know that ticket scalping is illegal, so why do people get away with it on eBay? Are there simply too many listings for tickets that eBay couldn't possibly catch all of them, so they don't even try? Sure, a couple of those listings may be people who bought them and then had something come up and are just trying to get their money back and not make a kabajillion dollars, but the majority of listers have multiple tickets at ridiculous markups. I think eBay even has a whole section for nothing but tickets. Is there an exception for eBay, because technically you're auctioning them?

Law-type people (and those who play them on GC), what gives?

Just for the record, ticket scalping isn't illegal everywhere. It's legal in Seattle.

Legal in Hawai'i as well.

I've bought a bunch of UH football tickets from scalpers over the years right outside the entrance. Depending on how desperate they are, they usually sell em for less than the face value so they can get out of there and it's not a total waste...which works for me since I just needed a ticket to get in, anyway.

It's legal in Ga but you can't stand within a specified distance of the venue in some places, like the Atl. Braves stadium.

I don't think that is true. Licensed brokers can scalp. That is the real crime.

Actually, from the sounds of this Seattle P-I article from 2005, anyone can scalp tickets. No permit needed. http://seattlepi.nwsource.com/local/...calpers17.html
