I don't think it is. I think the only way a rapist is getting off is if he's a rich celebrity and has enough money to hire a high powered attorney. Then maybe.

I disagree. Anytime a thief/rapist or whatever can break into someone's house, see a gun and then turn to run only to get shot in the back and then have the person who pulled the trigger sent to prison for shooting a stranger for breaking into his/her home. If that's not protecting the criminal then I don't know what is.

My parents live next door to a judge. I hear all kinds of crazy scenarios that don't make sense at all.

Unfortunately rapists get off (pun unintended) a lot because so much of a rape case is circumstancial unless there is indisputable DNA evidence. Normally it'll be a his word vs. her word case. For this reason, a lot of rapes and sexual assaults do go unreported. I'm sure that a thread asking people on GC who's been raped and/or sexually assaulted and not reported it would garner quite a few responses.

My question is this? If there is enough evidence DNA and all to convict him, then why should it be his word against hers? It shouldn't. I don't even think he should get a trial at all. Just send him to prison.

You kind of acknowledged my point and then missed it. When there's hard evidence it's much easier to convict (though of course sometimes women and men are extremely vindictive and will decide after consensual sex that they 'changed' their mind.)

If the case is just a testimony, it's more difficult to prosecute. If the DNA is there it's not really a he said she said case anymore.
Also, working with prisoners on a regular basis in my job, I have to come into contact with these assholes all the time. I hate it. Medium security is worse than max because medium will have more child molestors and rapists. This is because they get moved down a level due to good behaviour. We get some real scumbags occasionally. The guards will tell us what's up with each inmate.

centaur, I didn't know you did that for a living. Wow. Do you ever get scared? Do any of the criminals try to hit on you or threaten you?

PrettyBoy, locking people up for life if they hurt someone else sounds fine and dandy but good luck finding the money or the space for it. Nothing is that simple.

Actually I'm an EMT but we go to the local correctional facilities to get inmates and bring them to hospitals in Boston. Some of the inmates are so nice that you forget that they're in there for a reason, occasionally a really horrible one. I've never been threatened, but I'm pretty sure I've been checked out quite a few times.

what is the sentence for being convicted on rape charges? how many years does it get?

i know there are quite a few jobs/careers you wont be able to pursue with that on your record, but if said rapist is found guilty (which i take it to be not so much), are those his only consequences: jail time, being denied certain jobs, and being on a sex offender registry?

and what happens if a woman loses a trial, in that she lied about the rape (and that it never happened, cause we know cases like this do happen). is there a consequence for her, aside from looking like an ass? is she just charged with purgery (sp)?

Because he says she consented and she says she didn't. Semen is proof of intercourse, not proof of rape. And say they're both drunk off their asses, who was raped? The aggressor? Both of them?

Sentences vary a LOT depending on what state you're in and the type of offense and prior history. I'm pretty sure Probation is potentially an option in some areas, mandated therapy can be done in conjunction with jail time.

Most people are reluctant to charge an alleged rape victim with perjury because it IS possible it happened but couldn't be proved. But it's becoming more common if it's clear she lied.

He shouldn't have been drunk. He should have been more responsible. Her too. Plus, they can tell if there was forced penetration. I just think things should be cut and dry, black and white. None of this grey area stuff. I would suck as an attorney.
