Either my school doesn't comply or there are circumstances which allow some buildings not to have elevators. There's a building on my alma mater's campus that, to this day, doesn't have any elevators. There's a handicap ramp and a handicap accessible bathroom on the first floor where the conference rooms are. But, that's it for ADA-compliance (in that building, anyway).

If a building is over a certain # of years old, and it was built before ADA requirments and it would ruin the building to put in elevators and the like, they don't have to have them...there is a movie theater by me like that, and while I love the theater, it is a pain in the neck.

What happens if a handicapped person wants to work there? Could (s)he potentially sue the theater?

No, but they would have to "reasonably accommodate her". Meaning making sure all of her job requirements could be done from the first floor, or finding some way to get her up the stairs, etc...

At the college i went to last year of the 5 dorms only 2 had elevators and for all of the academic buliding only 1 had an elevator and 1 was begining the process of installing one.
