The indictment gave a window of more than four years — from November 1, 1997 to February 1, 2002 — for which the act could have occurred, but Kelly's lawyers successfully argued that the time frame was so broad it prevented him from giving an alibi. Motions filed by his lawyers also suggest that the tape was made when the girl would have been of age. Kelly is due back in court on November 4th.
