Well... the rest of the world doesn't necessarily know Ben wasn't on the plane. He obviously has access to fake ID stuff (remember the numerous passports in his hidden closet?)... he could be part of the O6 as far as "Off-Islanders" are concerned. And since the rest of the O6 are hiding info/lying anyway, it might not be that much of a stretch to imagine they're helping with Ben's cover.

ok...it was confirmed...Ben so far, is not counted among the Oceanic 6
