It does indeed depend on the state -- specifically, as I recall, the state to which the alcohol is sent/delivered. It has to do with (surprise, surprise) taxes and regulation of sales -- in some states, only the state can sell certain types of alcohol (such as scotch); in other states, sales are more heavily regulated than in others. Usually, though, I have heard of the issue arising from orders, like someone living in State A ordering wine from State B.

I heard on the news the other day that currently 24 (I think) states allow alcohol to be home-delivered from another state.
