A quick google shows you're at Alfred State, looking on their Greek Life page it shows:
"
Based on previous serious violations of the College's Code of Student Conduct and criminal law that jeopardized the safety of students, Psi Delta Omega, a men's fraternity, is not recognized by the College. Students who choose to rush, pledge, and/or join an expelled organizations can be charged disciplinary and dismissed from the College. If you have any questions regarding the Greek system, please contact the office of the Associate Vice President for Student Life at (607) 587-4371."
The college can do this. You aren't a national organization so there is not much your group can do. The college has a duty to protect students and if you're organization was kicked off for hazing or some other activity that presents a threat to student safety, they are within their right to expel members of your brotherhood.
Also based on what the university has said, violating criminal law sounds serious and not "stupid stuff."

I'm not going to comment on your rights or the permissiveness of the school's activity, but I will say this. You might want to use the search function. Not only is Alfred U's situation discussed in detail in several old threads, I'm sure the answers you are looking for can be found there as well.

Agreed, this sounds a tad more serious than just doing something "stupid".
You chose to join an organization that the University has plainly stated that members may be "charged disciplinary and dismissed from the College." Can't say you weren't warned ahead of time. Ya'll really don't have any grounds to complain when the University followed through.

I feel you guys just need to deal with the consequences. You guys know the schools stance on the situation and the possible outcomes especially now that you and your brothers had to deal with it. I agree with you guys for trying to keep your chapter going and for holding it down so that you guys can continue the name. I feel a second chance should always be there, my chapter is thriving and one of the premeir on campus now in all aspects, and that was only possible due to the school giving us a second chance years ago.
