He's being overly technical by saying That immigration violations are not a "criminal" act. It's also not a criminal act to drive dirty either, but what happens when you get busted?

Call it what you want but if you get caught being here illegally you get arrested, are to appear before a judge, and in some places sent to jail For a few weeks before being deported.
