This is true (and why the term "undocumented immigrant" is used by the courts - technically, there's no criminal act involved in entering the country without proper credentials in the sense most people would think of it), but I'm not sure exactly where you're going with it - making it 'illegal' in a criminal sense will be a total f-ing disaster from a time/money standpoint.

Right now, part of why the Federal system is broken because it relies on employers as enforcement, for a large part. This does not work, because employers a.) aren't good at this and b.) have absolutely no incentive to enforce the law.

So why would we expect further codification to make it work all of the sudden? And if it does work, aren't the results (in terms of money spent and reassignment of law enforcement efforts) at best a wash and at worst a disaster?
