Boy in oral sex incident sues school district
By Tony Scotta, Macomb Daily Staff Writer March 12, 2003 The family of a St. Clair Shores student hopes to return their son to school after his suspension for taking part in an oral sex act while in class. Mount Clemens attorney Robbie D. Lang has filed a lawsuit against the Lake Shore school district in hopes of getting his client, a 14-year-old eighth-grader at Kennedy Middle School, back in classes. Lang said the boy was "victimized" Feb. 6 when a female student performed oral sex on him during a science class. **:eek: :o The boy, a special education student, was suspended for the remainder of the school year, he said. CT4 says: BOTH HE and THE GIRL should have been suspended. The girl involved was not implicated in the lawsuit. Lake Shore officials would not say whether the girl has been allowed to return to class, although some students said she has not returned. The district had also initially suspended the teacher, a 9-year veteran, but has since cleared him of wrongdoing, arguing that the "wrong in this incident is the actions of the students," according to a letter sent home to parents in late February. The teacher, whose name was also not released, has since returned to teaching and had argued he was unaware of the incident at the time. As many as 20 students were in class while the act was performed underneath a long laboratory table, St. Clair Shores police Detective Joe Mason said. Mason had stated that criminal charges involving the students would not be likely. "It's absolutely absurd that this could happen in a classroom. For the school district to say it wasn't negligent is highly ridiculous," Lang said. Lang particularly finds absurd the district's decision to compare the realization that the incident had occurred with the atrocities of Sept. 11, 2001, in their letter to parents. "Just like our country was shocked into awareness when, never-before acts of terrorism occurred in New York City, our district was shocked into awareness when middle school students engaged in indecent acts in the classroom," wrote Superintendent John Brackett and Kennedy Principal Paula Quintero in their Feb. 19 correspondence to parents about the incident. Brackett and other top Lake Shore district officials were unavailable for comment Tuesday, said district spokeswoman May Mulla. To combat a belief the sexual behavior is part of a greater "societal problem," based in part on adolescent exposure to the media, Internet, music videos, and movies, the district is encouraging parents to attend a March 18 forum at the school entitled "A Night With the Experts." The 7 p.m. program will include a discussion about those influences with a sexual abuse expert as well as media consultant Teresa Tomeo, who advocates higher moral standards for broadcasting. But Lang said the notion others are to blame is too convenient. He argues his client was statutorily raped, as minors cannot give consent under the law. In this instance, he believes the female may have performed oral sex on the boy as a dare, and although the boy didn't fight her off, he had no legal duty to do so. Lang's lawsuit seeks at least $100,000 for damages stemming from district negligence, breach of duty, discrimination, and intentional infliction of emotional distress, among other claims. The boy also suffered from a broken leg at the time and had his mobility hindered by a cast, he said. BWAHAHAHAHAHAHA "It certainly wasn't something that was planned," Lang said, arguing if a girl had been victimized, the district would have treated her better than his client. Stacy Moss, whose daughter, Ashley Zimmerman, attends seventh grade at the school, agrees the boy should be allowed to return and lays a majority of the blame on the teacher. "I hope he is allowed back," she said. "The teacher should have known what the students were doing at all times." But district officials maintain the teacher did nothing wrong. "He was working individually with students, while the remainder of the class worked at their desks," stated Brackett and Quintero in their Feb. 19 letter. "We also found that most of the other students in the class were unaware of the inappropriate behavior." What do you think??? |
Both of them should have gotten suspended for 10 days, and the teacher suspended WITHOUT pay (at the least) OR fired (at the most)!!

I'll bet my next paycheck the parents who don't pay any mind to teaching their children morals at home will be the first to be outraged and blame the school/staff/etc for not doing the parents' job for them. IMHO, it's too easy to pass the buck when kids aren't learning what they need to learn to be productive individuals. Good article, so here are my thoughts...
- I do not think the teacher should be penalized, because more that likely if the room set-up was that of a traditional science lab, he wouldn't have been able to notice someone under the table, especially if he was busy giving students individual attnetion and help. -I do not think the girl (who performed oral sex :o ) or the boy (the recipient) should be suspended. I believe that instead, they should required to attend some type of sex education/counseling with their parents, especially the young lady. Sorry but sitting at home for 10 days accomplished nothing....if anything it opens up a door of opportunity for more :o while the 'rents are at work. -On one hand, I do think the school is trying to handle this situation by offerring the "Night With The Expert" syposium. This should be a wake-up to the school that maybe their science/sex education programs needs to be revamped - maybe include some type of round table discussion groups where kids are able to speak honestly and frankly about sexual behavior. On the hand, the school's decisions are busted by pushing the blame on the teacher. While I do not believe this event to be of the same magnitude as Sept. 11th (:rolleyes: ), I do think that it can serve as a wake-up call to parents - kids are being exposed to sex and sexual topics at earlier ages. HBO Family has a documentary call "Middle School Confessions" that is currently being aired that features junior high age kids (12-14 age range). On one episode, the girls were bragging about performing oral sex, saying that it is ok to do because it's not like having sex....WTF :eek: Oh, and these were your everyday, suburban girls. |

What is interesting is there are a lot of people who have the mindset that until they have intercourse, then they are still virgins. There are even folks who think that as long as they are only having anal sex, then they are still virgins. |
I agree. I don't think the teacher should be blamed...they can't be everywhere watching EVERY student. I'm not a teacher, but I hope to be soon. I find this very disturbing, and I'm asking myself what I would have done...still don't have an answer yet.
Someone needs to talk to these pre-teens/teens about sex and do something that's long lasting. Both of these kids sitting at home for 10 days does nothing, and who is to say that the girl won't do it again or continue doing it some other time. I wish they had Sex Ed in more schools. As HK1974 already stated, kids are BOMBARDED by sexual images ALL of the time. However, I think the best sex ed starts at home...and that means parents cannot be nervous or shy about answering questions about sex. I think it's unfortunate, but definitely a wake-up call. Some people are still in denial about these young people having sex (whether it's oral, anal, whatever-it's all SEX) at a young age. It's happening people. I have HBO Fam...is this new? I will be on the lookout for it. It sounds interesting. |

I am sorry for my reaction and use of language, but children today make me CRAZY!! I have students that have sex at school or wherever they choose. I even caught one of my students in the hallway with her bra undone and a little boy feeling her up! :mad: :mad: I, too, have Sp. Ed. students and they don't suffer a lot of conseqences because people think Sp. Ed. means crazy and retarded. THESE CHILDREN KNOW WHAT THEY ARE DOING!!! The system is messed up and this Sp. Ed. stuff needs to be reevaluated. As for the little boy's leg being broken, did he have something in his mouth that made him incapable of saying STOP! or alerting the teacher that a girl was "victimizing" him in class? |

Hey ya'll, I'm sorry for my harsh judgment of the situation. At the middle school I work at the special education students are sent to the social worker or the social work intern (me) as opposed to getting sent to the principal's office or getting suspended. The administration feels that suspending special education kids puts them at a disadvantage when IMHO it does nothing but tells them that short of blowing up the building or killing someone, they can do as they please b/c they won't get suspended. When special education students break rules at my school, the most they get is to have their parent come in for a conference. And when the parent does come in, they get upset with me for taking them away from "The Young and the Restless" or from their boyfriends to talk with me about their child's behavior and/or progress in school. It really burns me up!! Special education does not equal stupid; I know that these kids are smarter than what the district labels them and I feel that some of these parents do not encourage their kids to do better for fear that they will lose some money or that (gasp!!) they will have to be more involved with their children. :mad:
Everyone is pushing for abstinence when teaching sex ed, but it just ain't happening, people!! I read a journal article about teens and sex for a human behavior class and I was shocked to learn what middle school kids are doing!! Parents need to REALLY teach them about sex, and when I say that, I mean teaching them more than just how not to get pregnant or how not to get someone pregnant!! I was harsh in my judgement of the situation and I now recommend that the boy and the girl (especially) be sent for intensive individual counseling WITH their parents!! As for the teacher, nothing should be done to him but I know now that he will keep a sharper eye out on his students. :o :( |

Were their "experiences," that they were so eager to share, worth all of the consequences they were and could experience? There was utter silence:(. One boy stated that we gave them a lot to think about and I replied that's all education is supposed to do, enlighten your lives and inform your decisions. Many kids are having sex because they do not know that they don't have to. With all of the misinformation about sex that they see everyday, I see a generation of young people yearning for more information on the subject, both biological, intellectual, and spiritual. Abstinence is not even considered by most kids as an option. An empowered sexuality education class will equip kids with all the information that they need about the subject. That same boy that said he had a lot to think about also stated that he didn't know you could get herpes from just laying down with a girl, and that certain forms of it were incurable, but yet he has sex :eek: . Other boys thought that AIDS came from Africa because the people over there are "so dirty" (these are black boys mind you :mad: ). Most of the boys didn't think that abstinence was possible, but most of them saw it as the best thing for them (which is a start). Now we have to teach them to love themselves enough to allow for abstinence to be possible in their own lives. An empowered sexuality ed class will not just say sex is bad, don't do it (because the truth is that sex is beautiful) . It will empower kids to arrive at the best possible decision about sex for them, and benefit us all. Blackwatch!!!!!! |

This was mentioned on a listserve that I am on with sorors and this really concerns me. I know a lot of you are parents and maybe you are not aware that this is going on, but it is. . . :(
**I tried to edit out as much as possible the offensive terminology.** The kids call the game P_____ Poppers. Girls wear these multicolored rubber bracelets on their arms and a boywill come up to them and try to break one... each color bracelet has a different meaning.....the girl will have to perform the act for that color. Students have been suspended from schools for selling them. These are the meanings for the colors (in DC). *NOTE: THESE ARE THE CHILDREN'S MEANING AND TERMINOLOGY!!!!! Black: Sexual intercourse (sex) Blue: Oral sex Green: Outdoor Sex Clear: anything you want Orange: Kiss Yellow: Hug Red: Lapdance (3 minute max) Purple: Usual Sex (doggie style, etc.) Silver: Fisting (hand in vagina/butt) White: flashing your breasts Pink: flash anything Gold Glitter: make out Brown: toss my salad Glow in Dark: sex toys Spikes: same sex AGAIN EVERYONE NEEDS TO KNOW THIS INFORMATION. I live in the Baltimore Metro area but I am sure this game is not isolated to this area. These activities take place after the parent leaves but before the child goes to school or during the infamous hours after school but before the parents come home. |
As a 14 year old boy, in almost any normal school, you would be a freaking idol if you got a blow job in class . . .
Hell 10 years ago getting a blow job at 14 at all was pretty noteworthy. People are going to have sex. Keep in mind that 14 is old enough to marry by a lot of state laws. The real issue is to try and teach them that they should have been a little more discreet. Any issue as to how soon they should be haivng sex is really up to the parents. Denying them an education over it, which a year long suspension does, is ludicrous. As far as the teacher . . . He didn't do anything wrong that the article reveals. The lawsuit . . is well . . . stupid . . although, if the boy had gone down on the girl, I wager she might have gotten a lot more sympathy for a suit. |

I wasn't thinking about bjs in elementary OR middle school...ewwwww..shoot, I didnt even know what "tossing a salad" meant until a few years ago and I am 27! While I agree that abstinence should be taught in sex ed, I also think that these kids should be given the ENTIRE story. In HS, we saw a film of a woman giving birth. That was 2 years before I took the plunge, so to speak. I'd rather my daughter know the whole story about sex, FROM HER PARENTS, than to get wrong information on the street or from her friends. And I commend the males out there doing their jobs as fathers/father figures. A big part of the reason why girls become sexually active can be linked to the absence of a father... *smh* |

This hit close to home recently. One of my best friend's close relative ( she's 13) ran away from home for three days. When police brought her back home, her parents found out she had been with a boy but she couldn't remember how many she had been with. Now that htat has happened, she has had incidents at school where guys are throwing money at her telling her to them. It's sad. She still doesn't see how dangerous this is. She wants everything she wears extra tight and now walks like a peacock so her butt can stick out more. I just shake my head and hope she learns before it becomes too late.

I am on the same listserv as CT4 and one of sorors indicated that these things are all over the ELEMENTARY SCHOOL she teaches at. I was still playng candyland in elementary school and was not thinking about having sex of any kind with anyone.
Anoother soror I shared the article with indicated that her husband who teaches here in the city, caught two kids having sex on the bathroom floor in the last couple of weeks. Unreal. |

To clarify some things on Special Ed students (for some reason that stuck out like a sore thumb)... They CAN be suspended, but they can't go over 10 suspension days in a year and it CANNOT be related to their disability (i.e. a child with Tourette's cannot be suspending for cussing in class, if that is one of the outbursts he has). People sometimes shy away from suspending them because they're scared and don't know the laws under IDEA (Individuals with Disabilities Education Act). While their suspended, they must continue to receive their educational program, which in a lot of cases would just mean an in school suspension since most school can't afford an inhouse aid to teach them. Additionally, depending on the child's disability, he may NOT have the skills needed to make those types of value judgements, BUT has ENOUGH skills to be included in a general education classroom (autism, mild mental retardation, etc). They are including more special ed students into the general classroom, so teachers have to be mindful of these things. (But he very well could have done it cuz he was horny...) (sorry, Special ed major and I have school on the brain :D ). But, WHY wasn't the girl suspended if he was? That is not right, she was the one doing it. And I remember science lab, you CANNOT see all students at ALL times. This is NOT the school system's fault, unless you want to blame them for not having sex ed to curb this kind of behavior. I had sex ed in elementary. And I mean, most of us didn't do anything, but when we, er, they did, they were smart enough not to do it in friggin class. The bathroom, maybe, but not class. ;) |
I was watching Oprah the other day and she was discussing this same topic with some parents on the show. One parent said that her son told her that oral sex was nothng more than a goodnight kiss while another parent's son said that it was impersonal and meaningless. I was :eek: ! I remember when I was in HIGH school (not middle school or elementary school) oral sex was like ewww, yuck and only the biggest garden tools did that. Even when I started college, oral sex was something that you did with your boyfriend/girlfriend and ONLY if ya'll had been together for a long, long, long time.
Shoot, when I was in 8th grade, I had a boyfriend but I thought him putting his arms around me or holding hands or kissing me on my cheek or forehead was THE biggest thrill of life!! :D I'm glad for the heads up on the bracelets because at my agency, we have several girls that are wearing the bracelets but I don't know if the meanings are the same here in the Detroit/Flint/Saginaw area. I'm sure they are, though. I'll make sure to mention it in the staff meeting on Monday. |
