New SCOTUS nominee

Elena Kegan: First woman dean of Harvard Law School. Clerked for Thurgood Marshall, long history of political involvement. I know some of you are probably familiar with her.. so, what do you think?

Kevin 05-10-2010 08:16 AM

Not surprised?

AOII Angel 05-10-2010 08:21 AM

Yay for another woman on the court...I'm happy that we're getting close to parity! I'm not surprised either, Kevin.

Elephant Walk 05-10-2010 11:30 AM

Even bigger deal for the LGBT crowd..

It looks as if we have the first transgendered Supreme Court justice!

That's just rude.

This picture contradicts you.

She looks like my uncle and she probably played in the NFL. I've seen much more convincing transgendered people. Shit, that one male/female on Real World was more convincing than this one.

She looks like Will Ferrell's impersonation of Janet Reno on SNL.

Low C Sharp 05-10-2010 12:16 PM

This kind of post makes me absolutely giddy with delight that this woman is about to become one of the most powerful people in the world. She'll be telling Elephant Walk what he can and cannot do for the rest of her life, and we'll get to watch him squirm under the reality that she owns him. I hope she lives to be a hundred and ten. I'll be enjoying every minute, EW.

hahaha, you're right

ETA: She's never been a judge. Has anyone else on the Supreme Court not been a judge?

It drives me absolutely crazy that so often, people think it's ok to criticize women on the basis of their looks instead of on the quality of their work.

I don't think this is a gender issue (criticizing the woman based on looks); I think there would be a similar response if the nominee were an effeminate male.

You may be right. So the "problem" is more that she looks masculine than she wouldn't be considered attractive? That makes some sense, although I still think it's extremely pathetic. Because there are certainly some male justices who are extremely hard on the eyes (for example, Scalia), and I don't remember people bringing looks into the conversation when they were nominated---but they don't exactly look effeminate.

William Rehnquist, who went to become Chief Justice.

I think you can criticize them on both.

But I don't know the body of her work because I don't have the time to go look it up (nor do I really care, either). But all I have to do is look at her and realize she's a dude.

Ha!! Great post.

BTW there is very little body of work to go on.

Reminds me of the Aerosmith tune... "Dude, looks like a lady" 'cept in reverse.

Psi U MC Vito 05-10-2010 02:29 PM

She isn't the first Solicitor General to be selected is she? Also wasn't there speculation she would have been the person appointed by a democratic president, before she ended up becoming SG?

For as much as your first post pissed me off, this one cracked me up.

Nope! There may have been others, but I read earlier this morning that Thurgood Marshall was SG before being selected, which was a trivia fact because Kagan clerked for Marshall.

Apparently 41 of the 110 had not been judges before being confirmed as justices. That's a pretty good precedent.

And honestly if a non judge is selected, I can't think of somebody better then the SG.

So Elephantwalk...she's an overweight, middle aged woman. So what, you don't want to date her. I don't think she's missing anything! I'd take her accomplishments over your approval anyday!

He'd be barking up the wrong tree. I don't even think he'd be in the right forrest.

I don't get why you're so offended? People can tell she's a lesbian the same way they can tell Clarence Thomas is black.

It is about both gender and sexual orientation. They are correlated.

She is unattractive, but she'll be in good company regarding that. I see what EW is saying and it is tongue-in-cheek (I hope there's no pun there) as far as I'm concerned. ETA: Scratch that. I think I interpreted his attempt at sarcasm differently than he meant it.

So, this went from her being transgendered to her being a lesbian? I hope you realize that those aren't necessarily one and the same.

I'm offended that he's criticizing her for not being attractive. Like others have pointed out, no one criticizes the male appointees for their looks. He hasn't criticized her for being a lesbian, only for being masculine which doesn't make her a lesbian. Neither of those traits would make her any less qualified than her equally unattractive male peers. It's quite insulting to have a woman's qualifications for a positions completely ignored so that her looks can be addressed instead. As for being able to "tell" she's a lesbian, she looks just like half of the moms I know. I might be able to tell if she told me she liked women. ;)

You need to get out (no pun intended) more and expand your brain.

I tried that. I got jumped. Now I'm staying in.

My brain expanded too much, now it looks like a stretched out rubber band, never to again to attain its (shouldn't there there be an apostrophe at the end of it at least, like this: its', as opposed to it's) former elasticity.

You don't have to be a liberal to be offended that a woman can't be judged by her academic/legal merits like her male colleagues instead of her physical appearance.

Ghostwriter 05-10-2010 04:58 PM

Are we sure she is not Chas Bono?

tsk, tsk, Ghostwriter. Chas is a man (or I'm sure you'd say wants to be one.) Elena Kagan clearly is a woman, wears women's clothing and jewelry, and is not trying to be anything other than a woman.
