Update January 26, 2009: Suit Filed, Warrant Issued
Excerpt from article on an Alabama paper's site: The family of an Auburn University student who was injured at a fraternity house earlier this month filed suit Monday afternoon against the national fraternity, the local chapter and a fraternity member. The suit was filed in Lee County Circuit Court by Beasley, Allen, Crow, Methvin, Portis & Miles of Montgomery. The suit, on behalf of student Taylor G. Jones, was filed in the name of his father, Michael G. Jones. Sigma Phi Epsilon fraternity and the local chapter of the fraternity are named as defendants, as well as a student the law firm says is a fraternity member. . . . See entire article at http://www.oanow.com/oan/news/local/...student/56383/ Also, station WTVM reports (excerpt): . . . the Lee County District Attorney and the Auburn Police Department issued a warrant Monday morning for the fraternity member accused of assaulting him [i. e., Taylor Jones]. 18-year-old Zachary Quillen, a member of the Sigma Phi Epsilon Fraternity, is being charged with Felony Assault in the 2nd Degree, stemming from the alleged incident back on January 11th. . . . See the WTVM article at http://www.wtvm.com/Global/story.asp?S=9734801 |
Haha Sig EPPPPPPPP!
Anyone know if this is a BMP chapter? |

If it's not already, it will be. |
It's been a rough few months for Sig Ep's in the state of Alabama. My daughter is in a GLO at AU and this story just made me sick. What does BMP mean?

They should at least wait until the findings of any trial or suit. On a separate note, if its found that the fraternity and member in question are not at fault, or even that it is the plaintiff who is at fault, will the chapter have the opportunity to counter-sue for punitive damages? |

Theoretically, I could say "It could happen," but once these cases are dropped, they're dropped. More than likely, if the plaintiff here thinks he has a dog of a case, he settles for nuisance money (they call it an undisclosed sum) and the thing goes away. As for getting BMP forced upon them, I'd by lying if I said I knew how that worked. |

It may seem wrong to bash our own nationals on our public forum but they deserve it. The dialogue has been going on within the fraternity for quite some time and it seems like they've won. Sadly, if (and when) they see that the bmp is a flawed idea it will likely have already ruined the fraternity. |

Most everyone has some sort of national programming now. Sigma Nu has LEAD (which is a bit more open-ended as far as I can tell), ATO has something Pike has something... I'm pretty sure everyone does. The reason for that programming is all the same -- replace pledging with more benign, but hopefully still meaningful activities. The goal? To limit the liability and exposure of the national fraternity and the individual chapter to negligence suits, hazing charges, etc. I'm not sure whether it's worth it. I guess time will tell. |

Does "any excuse possible" include a pledge ending up in the emergency room? |
If you're referring to Alabama, then yes of course nationals needs to look into that and then take any actions deemed necessary.
But I was talking about the situation at Auburn and the idea that nationals would try to force the BMP on the chapter after 1 member was involved in a parking lot fight, the details of which are unknown. If that was the case, it would be an example of nationals far over-stepping their boundaries. |

The prospect of reduced donations form alums of a particular chapter? |

I would say that most HQ's have way more power than is due, or that they're really even worth for the chapter. They pretty much just exist to buy insurance. |
This was a simple parking lot fight. I've seen a couple fights and I'm really confused - how did that guy end up in the ICU? Is that even possible, to put someone in the ICU just with your fists?
The fights I've seen leave the guys with broken and bloody knuckles, maybe a broken nose and a busted lip. Painful, but not ICU material. |

You can also put someone in the morgue with your fists. |
True. That's why I think all such disputes should be decided by Breakdance Fighting.
|
If the guy falls down and hits his head on the concrete, he can either end up in icu or dead.
I'm with the breakdance fighting! |
What about a dance off?

You join a national organization and you expect your governance to be....? |
So how is this kid doing? Is he going to be OK?
I've only read that his parents are suing Sig Ep and I think the boys in the fight. No other news on how he is doing |
