She isn't the first Solicitor General to be selected is she? Also wasn't there speculation she would have been the person appointed by a democratic president, before she ended up becoming SG?

Nope! There may have been others, but I read earlier this morning that Thurgood Marshall was SG before being selected, which was a trivia fact because Kagan clerked for Marshall.

Apparently 41 of the 110 had not been judges before being confirmed as justices. That's a pretty good precedent.

And honestly if a non judge is selected, I can't think of somebody better then the SG.

He'd be barking up the wrong tree. I don't even think he'd be in the right forrest.

I don't get why you're so offended? People can tell she's a lesbian the same way they can tell Clarence Thomas is black.

So, this went from her being transgendered to her being a lesbian? I hope you realize that those aren't necessarily one and the same.

I'm offended that he's criticizing her for not being attractive. Like others have pointed out, no one criticizes the male appointees for their looks. He hasn't criticized her for being a lesbian, only for being masculine which doesn't make her a lesbian. Neither of those traits would make her any less qualified than her equally unattractive male peers. It's quite insulting to have a woman's qualifications for a positions completely ignored so that her looks can be addressed instead. As for being able to "tell" she's a lesbian, she looks just like half of the moms I know. I might be able to tell if she told me she liked women. ;)
