SAN FRANCISCO - A federal appeals court has ruled that a congressional act outlawing marijuana may not apply to sick people with a doctor's recommendation in states that have approved medical marijuana laws.

The 9th U.S. Circuit Court of Appeals ruled 2-1 Tuesday that prosecuting these medical marijuana users under a 1970 federal law is unconstitutional if the marijuana isn't sold, transported across state lines or used for non-medicinal purposes.

We still have inter state commerence laws? Nevermind that is not the point.

Marijuana should be legal. Life, Liberty and the Pursuit of Happiness. Am I the only one who's ever read that?
Some one is dying from pain, they have the right to do whatever it takes, as long as no one else dies from it, to stay alive.

Our country sucks ass if the person in charge enforcing the laws doesn't understand the basic principles this Nation was founded on.

I have to hand it to Ashcroft though. It takes a special kind of asshole to tell a dying person that they are wrong for taking medicine.

Why don't they have jurisdiction over colorado and maine?
