This will depend on both the laws of your state (and I know little about the Code of West Virginia, although I've gotten bombed there) as well as the situation. Again, though, you're missing the point -
You can have cigarettes and not be a nuisance as well. You can't walk around most places with an open beer, right? [NOTE that I mean this 'as a matter of law' - whether or not you can actually do it in a de facto sense is meaningless]
I understand the scale issues you're getting at, but I'm trying to point out a different angle here.

The key here is 'public' nuisance - you don't comprise the 'public', and unfortunately it looks like you disagree with the opinions the public holds.
