Artist hoping for fresh start after bankruptcy
Hip-hop artist Jacki-O declares bankruptcy as a way to seek out a new recording contract that will revive her career.

Jacki-O managed to pull herself out of poverty before; now she's set to do it again.

The Liberty City hip-hop star, who burst onto the Miami scene two years ago with her sexually explicit Nookie and image to match, is officially broke, declaring debts totaling $144,225 and assets of just $1,340 in a Chapter 7 bankruptcy filing.

''An artist would like to live a very fabulous lifestyle,'' the soft-spoken rapper, née Angela Kohn, said in an interview. ``But it takes money to look like money.''

The bankruptcy, which was filed late last year, has cleared Jacki-O's slate of debts, which ranged from Bally's Total Fitness to the IRS to Verizon Wireless.

But more importantly, it has eliminated an obstacle that she says was preventing her from jumpstarting her stalled career -- her early recording and distribution contracts.

Under the law, a bankruptcy can void personal services agreements, such as a recording contract, if terms of the deal inhibit the debtor's getting back on solid financial footing.

That was case with JackiO, who had a deal for some five records with Miami's Poe Boy Entertainment and a distribution agreement with TVT Records, said her lawyer Richard C. Wolfe.

' `Baby artist' contracts are inherently one-sided,'' he said. ``This was particularly one-sided. She was given a small advance and since then she hasn't been given one penny in royalties.''

Poe Boy Entertainment could not be reached. TVT Records spokesman Joe Wiggins said the label would look forward to working again with Jacki-O.

Bankruptcy has been used by a number of artists to wriggle out of contracts in recent years, including hip-hop trio TLC, vocalist Toni Braxton and Run DMC, but it doesn't always work.

In 1986, a judge rejected actress Tia Carrere's bankruptcy petition, ruling that she was filing in bad faith in order to cancel her contract with ABC Network.

The approach is not a common one but it is accepted, said music business professor Stan Soocher, who edits Entertainment Law & Finance journal.

''From time to time, artists have used bankruptcy to get out of a recording contract or attempt to renegotiate a contract. There have been a series of court rulings through the years,'' he said.

The Recording Industry Association of America has long backed changes in bankruptcy laws that would tighten the loophole for using liquidation to back out of contracts.

Under last year's bankruptcy law revision, judges can now consider a petition to nullify a recording contract when determining whether a bankruptcy filing is an ''abuse'' of the law.

Although voiding her contracts was a key strategy behind the bankruptcy, JackiO was legitimately broke, said her bankruptcy attorney Susan D. Lasky. Jacki-O cobbles together a monthly income of about $800 from fees for appearances and shows to live on.

''When she put out an album, things were so good, she didn't see an end to it,'' Lasky said. ``But she's like any other young person without financial experience.''

Now 34 years old, Jacki-O grew up in the gritty neighborhood of Liberty City -- ''where I live it ain't no palm trees,'' she raps on her 2004 album Poe Little Rich Girl.

She spent a period of her life on the streets, making a living from shoplifting from the tony stores at Bal Harbour. After dropping out of school, she later earned a GED and took college classes at Barry University and Florida Memorial University, studying criminology.

But since childhood, her passion has been singing and songwriting.

In the summer of 2003, she scored a smash single with Nookie, which turned heads with its graphic lyrics, and Jacki-O joined the small female rap scene which pivots on flesh and flounce.

It took more than a year of wrangling before her album was released, Poe Little Rich Girl. The record earned solid reviews but did not boost her career or income as she had banked on.

''The album wasn't being pushed as well as I hoped; the songs weren't on the radio. My video wasn't in the mainstream, like BET. It was pushed underground. I didn't get a second video like I was told,'' said Jacki-O, who in person seems demure and almost shy, the antithesis of her temptress image.

``I'm a new artist and it takes a lot to push a new artist. I didn't get a fair shot.''

TVT Records said her album was just the first stepping stone.

''Her record showed promise,'' said spokesman Wiggins. ``It's about building her career as an artist. That's what TVT is known for. We would be happy to put out another Jacki-O album.''

Female rappers face an uphill road in the overwhelmingly male hip-hop world.

Most women artists have to ooze sex in order to get noticed, said DaveyD, hip-hop newspaper columnist and radio programmer who runs hiphopcorner.com.

But that can make it difficult for fans to cut through the posturing to discern raw talent.

Jacki-O fell into that hole, he said. She was also sidelined by the fact that many record labels don't devote a lot of resources to more than one or two female acts at a time because the market for them is so small.

''The big problem is with the label side -- sex is sellable,'' DaveyD said. ``The women haven't really been allowed to have their voices nurtured without that sexual agenda of men.''

Jacki-O says she's hopeful she'll be able to land a new contract with a label that will put time and money into promoting her.

She's already written material for a new album called Jack the Ripper. The lead track is Monkey -- ''another name for nookie,'' she adds with a bashful smile, but offers no apologies.

''Women have to look very sexy, with their lyrics, the way they dress because sex sells,'' she says. ``No one wants to see you sitting there in a turtleneck.''

The raunchy nature of the words may be the same, but she promises the rhythm will be different. ``It's pop, a bit R&B, a bit hip-hop. I'm looking for a fresh start.''

Cassidy found guilty in invol. manslaughter (AP)

Should have gone to jail for them wack-azz rhymes! Luckly, he had some good people on the hooks.

PHILADELPHIA - Baby-faced rapper Cassidy was convicted of involuntary manslaughter and aggravated assault Tuesday in what prosecutors called the planned ambush of a man who had argued with the musician.

The 23-year-old Cassidy (real name: Barry Reese) was grossly negligent for supplying the guns that killed Desmond Hawkins and wounded two of his companions, Common Pleas Judge Jane Cutler Greenspan said at the end of a two-day non-jury trial.

Greenspan sentenced Cassidy to 11 1/2 to 23 months in prison. He has been in custody since his arrest in June, meaning he could be out of jail within a few months.

"You could be a leader in the community," Greenspan said. "All those guns — that's why Desmond is gone now, because of all those guns."

Police said that four different guns, including an assault rifle, were involved in the April 15 ambush in an alley behind Cassidy's house. Cassidy and his associates had stashed the guns around the alley in expectation of a shootout, prosecutors said.

Witnesses testified that Hawkins, 22, had gone to Cassidy's home to act as a peacemaker after Hawkins and his friends got in an argument with Cassidy and his friends.

"It's a tragic situation for me too," Cassidy told the judge. "I didn't set up for this to happen. Desmond Hawkins was my friend ... one of my closest friends."

Cassidy's debut CD, "Split Personality," peaked at No. 2 on the Billboard album chart and featured the top 10 single "Hotel" featuring R. Kelly. Full Surface/J Records released the follow-up album "I'm a Hustla" on June 28.

Cassidy was convicted of one count of involuntary manslaughter, a misdemeanor; two counts of aggravated assault, both felonies; and possession of an instrument of crime.

Hawkins' companions, Bobby Hoyle and Daniel Irvin, were wounded in the shootout.

NEW YORK (AP) - New York Knicks team president Isiah Thomas is accused of sexual harassment and discrimination by one of the team's former front-office employees in a federal lawsuit.

Anucha Browne Sanders claims Thomas made unwanted sexual advances toward her and refused to stop, according to the lawsuit filed Tuesday in federal court in Manhattan. Thomas and Madison Square Garden are listed as the defendants in the lawsuit, which charges them with sex discrimination and retaliation.

According to the lawsuit, the 43-year-old Browne Sanders sought assistance from her supervisor, Steve Mills, the president of Madison Square Garden Sports, but said Mills didn't do anything about the situation.

Browne Sanders, who had been with the team since 2000, claims she was fired as the Knicks' senior vice president of marketing and business operations last week as a result of her complaints.

The lawsuit also alleges that Thomas told Browne Sanders he was pushing for more home games at noon on Sundays. His plan, according to Browne Sanders, was to have opposing players go to certain clubs, including strip clubs, that Thomas had connections with on Saturday nights and get them drunk so they would be sluggish for the game the next day.

Ron Green, a lawyer for Madison Square Garden, told the New York Times that the lawsuit is "fabricated and outrageous." He said in a story for Wednesday's editions that Browne Sanders was fired "because of an inability to fulfill professional responsibilities," and said she is seeking "a financial windfall."

Lawyers for Thomas, Peter Parcher and Sue Ellen Eisenberg, called the lawsuit an attempt to make money and accused her of demanding $6 million upon her departure, more than 20 times her salary.

Browne Sanders said the problems began shortly after Thomas joined the Knicks in December 2003, and she repeatedly complained to management about his inappropriate behavior.

In court documents, Browne Sanders said Thomas often berated her, and made crude comments about her to Knicks officials, telling them not to listen to any of her directions. Point guard Stephon Marbury also is accused of acting in a hostile way toward her as a result.

Browne Sanders said Thomas' behavior soon became sexually charged, saying he told her he was "very attracted" to her and "in love" with her and tried to kiss her. She charges that last month, he hugged and tried to kiss her, and when she pulled away, he said, "What, I can't get any love from you today?"

Browne Sanders said she met with a human resources management consultant hired by MSG twice last year, and told the consultant about Thomas' conduct. After Browne Sanders sought legal counsel last November, MSG launched its own investigation but told her to not come to work for three weeks. She was fired last Thursday when MSG said her claims couldn't be substantiated.

Browne Sanders, the team's chief marketing officer, graduated from Northwestern as the Big Ten's women career scoring leader and was a two-time conference player of the year. She was the school's athlete of the decade for the 1980s.

According to the team's media guide, Browne Sanders is married with three children, and resides in New Jersey.

A person can be accused of harassing another for what you and I may think of something as being innocent. Michael Baesden did a show on it and some of the calls had me .

Example: One caller mentioned that the weather was fair to a colleague. The temp, according to the caller was 69 (degrees). The colleague took it the wrong way and thought the guy was sexually harassing her.

So true. You can literally look at people the wrong way and be accused. Staring/leering is considered a form of harassment.

I can see this happening. It is one of those situations where depending on whose side you hear it from it can either sound completely innocent or completely innappropriate.

For instance, I can recall on more than one occasion where my guy has taken any general reference to the #69 (temperature, prices, counts, you name it) and turned it into something sexual. Like "Hey baby. The weatherman says its going to be 69 degrees outside today. *wink wink* You know what that means *wink wink*" When I reply, "You're so dirty.", then he just smiles innocently and says "What, I'm just giving you a heads up on the weather. It means you should remember to take a jacket." It's cheesy and we laugh it off, but it would be offensive if he said it to someone else, esp. a co-worker.

This is what is soooo difficult about sexual harrassment. Often the devil does lie in the detail, in that it is difficult to prove the connotation and innuendo that makes a simple statement or gesture cross the line. I don't know if there is any validity to this claim, but hopefully his good name is not being marred for nothing.
