If it was a hit & run accident, why didn't they sue the driver of the car that HIT AND KILLED her?!?!?!

Seriously.. some of these lawsuits are RIDICULOUS!

They probably did. The tactic of the day seems to be "sue everybody and everything."

"Torre(the man who hit the girl) is serving a 9 1/2-year prison sentence on charges of negligent homicide in connection with the accident"

I would imagine that they came after the man as well, since he was found guilty.

I can understand why the Insurance carrier balked at the agreement. It is ridiculous. But it could be another case where it is cheaper to settle than to litigate. Wrong. Wrong. Wrong.

By suing the fraternity for serving her alcohol aren't they in a round about way saying it was her fault she was hit?

If they had served the DRIVER, I could understand a bit better.

In this case, one doesn't seem to have much to do with the other......

But hey, since when do these things need to make sense....

This reeks of crap.

Once again...there were choices made. She is an adult at the age of 18, but underage drinking. The party wasnt busted that I can tell, however they are pinning it all on the fact she was drinking.

No one poured the beer down her throat. No one made her go to the party. Sigh...its a case of "not MY daughter" on this...

Good to see that they caught the ass who hit her. HE is the one that should be charged....but I guess since they will fine a bar for letting ppl drive home drunk...then it now has gone to fraternities too.

Question

Damn,

A hit and run driver, go figure! She was jaywalking, against the law! In todays Society, a driver hits someone and trys to help them they get beat senseless for the effort as some dumb ass waked in front of them! Now what does a person do? Leave and call police or get beat near to death??

At a LXA Party!? It is always at a Fraternity Party! Is Jaywalking a sign of being drunk?

I do not blame Lloyds to dispute the claim! What evidence!

I hate for someone to get killed at anytime but get reall, it always because of Greeks!

Sometimes wish I went ahead and tried Law School, but I would be oh so pissed most of the time, I would quite!

I wonder if the parents want their other kids to jaywalk drunk, so they can cash in! Bling Bling!

sounds to me

It sounds to me like people are no long required to be responsible for their own actions.

Nothing new about that.

That's a large part of what Risk Management is about. If a person can't or won't be responsible (and some can't/won't) culture says that somebody or something must be where the buck stops.

This whole thing still baffles me.

1. She was underage and was willingly drinking anyway

2. She made the choice to break the law and jaywalk

3. She got hit. Driver wasn't intoxicated (at least not that the article said)

4. And the fraternity gets sued because they served her alcohol?!

Since everyone is just suing random people, I think the driver should counter-sue because since she was jay-walking, she caused endagerment to him in his car. He could have been hurt!

Seriously, this makes no sense!

It's the law. It doesn't have to make sense.

I guess this is the risk we take when we open our houses and facilities for parties. Sucks, but oh well.
