You're right - discrimination on the basis of sexual orientation was precluded by legislation passed at the Denver General Assembly in 2002.
The concept of "other valid reasons" is discretionary and can be interpreted broadly. Given the facts presented so far, it would not be surprising for the GHZ to find his resignation to have been for valid reasons.
