Isn't that the point that the plaintiff was trying to make in her case against the University of Michigan?

The plaintiff had a 3.8 gpa and scored 161 on the LSAT but she was denied admission while a "disadvantaged" minority with a lower GPA and a lower LSAT score was admitted to the law school. The flaw with the admission policy is the fact that some of the "disadvantaged" minorities are not disadvantaged.
