But that's where there is a fine line.... if you are drunk yourself (for example- I am not saying the passenger was, but am saying for sake of argument), and you are told repeatedly by your friend that they are okay to drive, and even sober people said that the person driving looked okay to them... isn't that being somewhat responsible in not driving yourself? What if he was so drunk that he really thought his friend was ok to drive? Whose responsibility is it then?
