Cutting legacies early in rush (NPC)

I have a question, what would happen if a group's RFM numbers required inviting 100 PNMs to round two, but they had 105 legacies going through? (assuming the group required legacies receive at least one invitation...) Or if there were so many legacies that only, say 5% of the invites could be extended to non-legacies?
I realize this is a little far fetched, but it seems plausible enough to have been considered...
