Very, very difficult to tell from news stories like this, which are somewhat notorious for (1) getting facts wrong, (2) not being even-handed with the facts and (3) failing to understand the legal issues as opposed to, say, the emotional ("that doesn't seem fair") issues. I'd like to see the actual pleadings.
Just based on what I've seen, though, I'd guess he'll have a hard row to hoe.
