Seriously. The way I think it should be done is we can start by not protecting criminals. Like centaur said, they live better than some innocent people do. The prisons wouldn't be over crowded if we started sending a lot of them over to Iraq, Afganistan and other countries we get into with. That's the best way to get rid of them. If they want to murder people let them murder our enemies. To me murderers and rapist serve no purpose on this earth. They shouldn't even be able to breath the same air we breath. I think it should be black and white, if you did it, you did it. No trial, straight to prison. The laws in this country are so backwards it's insane. Makes me wonder why we have the highest crime rate world wide. Well, of course we do if we're against the innocent and protect the guilty.
O.K. Home's I'm ready for you to slap me with your law degree and make my post look stupid. It still won't change my opinion though.

So . . . you didn't answer the question. How would you change the system so you can determine 'black and white' without, y'know, a court of law and rights for the accused?
OH ALSO - since it's black and white, cut and dry and all . . . might as well hire a friend to get close to PrettyBoy, get involved in some freaky sex, record some key role playing, then show up to the police with bruises and DNA/hair evidence, right?
You'd probably want to be protected then, hmm? Or are you seriously that out of touch? Get out of Edina or wherever and think for a minute, guy - you can't really think it's possible to "know" whether someone committed the crime without any due process . . .

We're really not even close to the highest in the world.
Murder rate: #24
Robberies: #11, behind the UK and Spain
Rape: #8, behind Canada
Our system is actually one of the best in the world, at least in theory - once again, in case you missed it: protecting the rights of the accused protects the INNOCENT, not the guilty - I cannot state this any more clearly.
So in short: you make no sense, did not answer the question, absolutely ignore any semblance of reasonable thought, then make up statistics. Good job.

KSig RC did such a good job that I have nothing else to say except that I am not FROM Minnesota and I doubt this guy is from Edina, he's probably from Roseville or Maplewood. Most people in the west suburbs are educated and a little more aware of the world.

Well, you guys asked so I gave you my opinion. I don't know how I would change the system, I'm not a lawyer, but I just have some strong opinions on rapists and murderers.
And to KSig RC, you've made some great points, but I wouldn't get involved with a woman in some freaky sex act. Maybe most men would, but I wouldn't. I wait for a long term relationship or marriage for that. For the men who get wrongly accused of rape, yes that is wrong, but they should think before they act in a sex situation like that.
A few months ago a guy cut up his wife and spread pieces of her body across a park. He did this. So now he's going to be represented by an attorney appointed by the State. According to the news he's able to afford an attorney, so why is the State appointing him one? Why should I have to pay for this psycho to be represented at all, for cutting up his wife into pieces? This is what I mean by cut and dry, black and white. No trial. Just throw him in prison and throw away the key. It's a waste of time.
And I'm not trying to argue with GeekyPenguin because she knows the law. She went to school for it, but I still have my opinion on rapists and murderers and we'll just have to agree to disagree.

It amazes me how many people forget this point.
Also, sort of on point; this fall in my criminal law course, we toured a maximum security prison in the area (most inmates doing life, all violent offenders), and talked to a number of the inmates. I would suggest such a trip to anyone, especially people going into law, and certainly people who are concerned that our criminal justice system is too soft on violent offenders.
