October 10 was the "second Thursday" of October that year, and was indeed the first meeting of the five undergraduate Betas.

But they were already back at school since ?

It was Monday October 7, as specified by the Miami catalog:

"The College year begins on the First Monday of October, and ends on Commencement Day, the Second Thursday of August – with a recess of ten or twelve days at Christmas, and a vacation of three weeks from the Second Thursday of March."

You will note that the "second Thursday of August" in 1839 was the eighth.

Incidentally I forgot to mention that "Blackstone" is a great name in the study of law: his Commentaries on the Laws of England was THE law textbook at that time. And except for Smith, all the rest of the Eight studied law.
