Its still an accident versus a premeditated crime. There is a tendancy in this country to approach every issue through the need to blame.
Maybe the guy will turn out to be drunk, mayeb it will turn out that witnesses were wrong on how fast he was going.
But it still is an accident.

If he had lived, He'd be charged with Intoxication Manslaughter (if he was drunk). If you are doing something reckless (like speeding at 100PMHG on a dark freeway) and it causes someone elses death, its no accident. Tragic, yes. But no accident.
