Dartmouth Fraternity Facing Criminal Charges

The Dartmouth chapter of Theta Delta Chi is facing criminal charges after a grand jury handed down an indictment. An recent alleged underagte drinking incident apparently led to an investigation and the charges. The student paper has a fairly long story, with a reference to New Hampshire law:

Here is a chilling thought...

"Because they are charged as a corporation and a non-person, it is a felony level offense," O'Connor said.'

As I understand the article, this law is specific to that state -- but it just underscores again how the dynamics of enforcing underage drinking laws are changing.

But, Who are these people?

So, am I missing somethng here?

Just Who Are They?

Now The Problems Become, "Well" they are a Greek Lettered Organization, ergo, All Are included?

Would really like a lot of info on this?

I think the 'they' - as in "Just Who Are They?" - would at least be the Omicron Deuteron Charge (Dartmouth chapter). However, the article is not clear who is meant by whole organization. So maybe the whole Theta Delta Chi International Fraternity.

Theta Delt, however, has been indicted on felony charges. According to District Attorney Chris O'Connor, who is not personally handling this case, the indictments are more severe because a whole organization is being charged.

I'm wondering if this has something to do with a 'corporate accountability' that I heard about a couple of years ago... something about you can not only sue the specific franchise/branch/division/department but actually go after the head office... problem is I don't know much more other than that - it came up at a meeting about litigation and GLOs here in Canada; but we were told not to worry because our laws concerning litigation are more strict. Any law types on GC know anything about this?

It is not without precedent. Remember that Arthur Anderson as an organization was found guilty for Enron. The worldwide organization across the world was effected, even though they had nothing to do with what happen with regard to Enron.
