Former fraternity member pleads guilty in assault

One of three former Minnesota State University Moorhead fraternity members charged with an August assault pleaded guilty Tuesday.
Joshua Lyle Orr, 22, admitted in Clay County District Court he kicked David Kath in the face on Aug. 16 in the 400 block of Eighth Street South after a dispute at Mick's Office.
Meanwhile, Moorhead police continued investigating Tuesday two unrelated assaults that took place outside Mick's Office.
Orr, 913 6th Ave. N., Fargo, will be sentenced July 5. He pleaded guilty to third-degree assault and third-degree rioting. An aiding and abetting assault charge will be dismissed.
Orr testified there was an altercation at Mick's Office involving Kath.
As he and three other men were leaving the bar and driving to the Phi Sigma Kappa fraternity house, they saw Kath walking home, he said.
They got out of the vehicle and Tyler James Schepper, 21, got into a fight with Kath. Orr testified he kicked Kath once in the face while Kath was on his hands and knees.
Kath suffered fractured bones in the nasal area of his face, court records say.
Schepper and Kevin Robert Vanzee, 22, also face charges for the assault. All were members of Phi Sigma Kappa but were expelled after the incident.
Schepper is scheduled to appear in court June 14. A warrant has been issued for Vanzee because he failed to appear for a March 21 court appearance.
