Arrow A mother's negligence?

Recently, there was an incident where a 3 year old child was killed. The child was not in a car seat, therefore, not properly restrained. The toddler was riding in the mother's lap at the time of the incident.

Should the mother be held accountable for her negligence? It is against the law to have children unrestrained in vehicles. Or has she suffered enough with the loss of her child?
