reinstatement of brother ???????

I have a question that hopefully one of you could answer. My chapter got in trouble a couple of years back and was almost kicked off campus. The offense was not a big one but they still came down hard on us and I had to ((as well as a few others) "take one for the team" inorder to insure that the zeta was not kicked off forever. Im glad that I could help because I felt bad that I was directl;y involved in the incident. Basically the only thing that has changed is I dont pay dues(too bad for the chapter), cant play intramurals(although I still go to all the games), and I cant go to meeting(although sometimes Ill talk to the Alpha and get permission to sneak in). I still hang around on a very regular basis and anything that theAlpha doesnt mind me going to I go. Im very much involved on the social scene with my brothers.......yadayadayada.


I was wondering if there is anyway to get back into the good graces of the national Fraternity. I am not ashamed of the fcat that I am about to graduate with not a clue as to what I want to do with life. I have always been interested in traveling around for a year or two while I try to fgurte out the next step in my life and ever since I talked to the first ELC that visited my chapter I knew that that was exactly what I was looking for. Im almost positive that there is no way I could become an ELC from nationals with my getting kicked out of the chapter. Brothers I need help, any of you have any comments of suggestions or loop holes in National Bi-Laws I would love to hear them

I think the chapter has to vote to reinstate you. Or they have to send a reconmedation to nationals to reinstate you. Hope that helps.

I think you need to give a little more information on the situation. PM me if you want, I will be here for you!

If it WAS only a situation of back pay, then I dont think you would be expulled, but was it maybe suspension instead. If this is the case, then if you pay up what is owed to the Zeta, then that would help clear up you problem. Then, the Zeta would petition Hdq for your reinstatement. It is usually just a formality.

But, if there is more to the story than this, then there might be a problem. Of course it would depend on what the situation really was!

Remember, Warren Cole was kicked out, but after many years was reinstated. One of the main things about LXA is that you can be forgiven!

If I am reading your posting correctly, you were expelled!

In addition, I have a feeling it was not for unpaid dues. If the HQ was involved, I can only assume that it was either hazing or a serious risk management violation was involved.

With all due respect, as a High Pi, I would have concerns that the High Alpha allows you to hang around.

That being said, the Constitution and Statutory Code is very clear in Code X-4 (Reinstatement After Penalty):

"a. Expulsion. In order to be reinstated after expulsion, the expelled member must present a petition for reinstatement to the Unit that expelled him. This petition shall contain a narrative history of the member, his association with the Fraternity, circumstances of expulsion, and reasons for application for reinstatement. Upon receipt of a petition for reinstatement, the Executive Committee of the Unit shall within 10 days (in the case of Chapters and Colonies ten (10) regular school days) present to the Unit:

1. The petition.

2. The original transcript from the High Pi's files or a copy secured from the General Fraternity.

3. A report on whether or not the member has abided by the penalty imposed (Code X-2-a).

The Unit may then hear statements from members, active or alumni, knowledgeable about facts of the case. The expelled member shall be allowed to attend the hearing and orally present his petition; however, he shall not be present during the voting. A three-fourths favorable vote of a quorum of the Unit is necessary for reinstatement either in full or for a lesser disciplinary status. The decision of the Unit, whether favorable or unfavorable, along with a copy of the petition, shall be provided to the Unit's High Pi (or the Grand High Pi, as appropriate -- see Code X-14) and one copy shall be forwarded to the General Fraternity by the Unit's secretary. The Unit may vote to restore the expelled member to full membership in good standing, restore him to membership on a lesser disciplinary status, or deny his petition. If the vote is unfavorable, the expelled member may not re-present his petition for a period of at least one calendar year. The Grand High Zeta may order any expelled member reinstated in full or reinstated and placed on a lesser disciplinary status."

Reinstatement

The brothers at my Chapter voted last night to Reinstate a brother who was forced to step down from the Chapter a few semesters ago. What we were told was that current voting active members of the Chapter must be present to vote on reactivating a member who is no longer active. 75% of the Chapter had to vote yes after hearing a petition that he presented to the chapter. this petition was supposed to be submitted to the fraternity, heard, voted on, and submitted at a minimum of 30 days prior to the reinstatement to Nationals. Nationals will then view the signed Petition and then notify the Chapter on whether or not we can reactive the brother. hope this helps.

Hope you are out there!

We also had a Brother expulled, He voted against our wishes in an IFC Meeting and caused a lot of problems within the Greek System.

He against My wishes was expulled. He used to come around the House after he Had Graduated. I wish to this day that I could find Him and get Him re-instated! He was # 3!

Had another Brother after I had been gone for sometime who smoked M in the House, He too was expulled. He is remoresful and wanted to return, the Zeta Said No Way for this infraction.

So, a lot boils down on the infraction and what the Zeta Says!

Then it is sent upward!
