As far as I know, the courtesy extended for a legacy (inviting back to the first invitational round) is the same for any legacy no matter what. At least this is true for my GLO.
Regarding your recs and the later, better gpa, you could let your rec writers know the situation so they can reference it in their rec info. In my experience, the final official gpa that the GLO looks at comes from the registrar's office not a rec... I assume you are going through rush in Aug since you are gathering recs now.
Do you know the min gpa that is required on your campus(or the houses you are interested in) for upperclassmen? It is often, a different, lower gpa from the incoming freshmen since it is assumed that a college workload is more demanding. However, this probably differs from campus to campus. A 3.11 would be acceptable on a lot of campuses, but again, I do not know about yours specifically.
