Woman Must Forfeit $1 Million Jackpot-Or Crime my not pay-out:

MEDFORD, Ore. (Aug. 10) - A judge ruled that a woman who used a stolen credit card to buy a winning scratch-it ticket has no right to the $1 million prize.

The credit card owner is dead... so there is no one to collect even if it was possible to award it to her.

I think this woman may have an appeal though--she used part of the winnings to pay the credit card bill, so a good lawyer could argue that it was never her intention to steal. She also claims she used her own cash to buy the ticket--if she has proof of that, she could win.

But for them (cops and prosecutors) to link the credit card fraud to the winning lottery ticket they would have had to found some proof that she used the card to purchase the ticket, otherwise they wouldn't have a case. Stores keep credit card reciepts and most (not all) convience stores now have security cameras.

Chances are they have the proof that she used the card to buy the ticket but she is now scrambling to keep the money and is now saying that she paid 'cash', which is convienent, because I know when I buy a lottery ticket I rarely ever keep the reciept for something I purchased in cash (that I know I can't "return").

The burden of proof is on her now, not the state.

wooow, since when do they let you use c.cards for lottery tickets? ive never been able to do that in VA...debit cards either. always had to have cash...

I always thought that lottery tickets couldn't be purchased with credit cards in my state either...then I learned that the gas station nearest to my house allows lottery purchases on a credit card.

Apparently (at least in my state), its the store's decision whether or not to allow lottery ticket purchases on credit card...any most of the retailers happen to choose not to allow it. (But its not mandated by my state.)

I have occasionally used my debit card to pay for a lottery ticket...if I was already paying for gas with the same card anyhow.
