Buyer of 'lemon' car gets double her money back

August 10, 2005


MILWAUKEE -- Adele Garcia has finally gotten rid of her Mazda Tribute, nearly four years after invoking Wisconsin's so-called Lemon Law.

The matter went to Circuit Court, the state Court of Appeals, the state Supreme Court, back to Circuit Court, back to the Court of Appeals and back to Circuit Court again before a settlement was finally reached last week.

''She surrendered the car and got $60,900, double what she paid, plus the finance charge,'' said Vincent Megna, one of her attorneys. ''Mazda paid us $138,600, which are our fees, plus they've got to pay their own attorney fees, and that will put this over $300,000.

''This all could have been settled 3-1/2 years ago if they would have given her the replacement vehicle she was entitled to.''

Good!!!

Maybe the Morons will quit depending on Computers and go back to the old way of testing them? Clay, wind tests, build and road test them instead of Saying "Well The Computer said it would Work".

It's funny how these states have Lemon Laws, but it takes 4 years and countless appeals to enforce them.

Geez...just admit it was a bum car!! They are machines built by humans. It happens.

My dad bought a new truck (waaay back in 1993), and when he finished the paperwork and drove off the lot, he got about 3 miles down the road and the engine froze up. He called the dealership, they came and got him (and the dead truck) and he got another one (same exact model, etc.) off the lot. No questions asked.

He's STILL driving that truck...it's got very close (if not over by now) 200,000 miles on it. That first one was just a fluke.

Psych - I dunno, with an initial experience like that, I dont know if I'd want another truck...I'd be paranoid.

Lemon Law

My parents invoked the Lemon Law after taking our Sequoia to Orlando. We had a pretty white one and as soon as we did the paper work we got a brand new pretty dark tan colored one, that DID NOT misfuction every chance it got.

Well, my dad's a "shade tree mechanic" (good one at that...one time he bought two Honda Accords (80's models...the real boxy ones). One had a blown motor, one had a bad transmission. Little "shade tree mechanic"-ing and...BINGO!! One fully functioning Honda Accord!), and he's bought that brand of truck before (I'm pretty sure it was a Chevy), plus the dealership didn't give him any crap, so he felt comfortable taking the risk again. I'm sure if something would have happened to the second truck he would have given them hell!

Man...my dad could tell some car stories...one time he was driving down the road when his old Ford Escort caught on fire. He says a Ford Escort acts really weird when it's on fire...the windshield wipers were going, it was trying to start itself, horn blowing...possessed, I tell ya!!

Kewel, that is when you get out and shoot the damn thing and place at rest! Junk Yard!

But the way all of the crapo that they put on it, the designers should be shot!

Difference, take care of car and it will take care of you. But if it is a piece of Crap?

It drives me nuts that companies just refuse to admit that they sold you a defective product. They will find every single loophole and fight you tooth and nail.

I bought a computer at Best Buy for college. We signed up for their equivalent of a Lemon Policy. Supposedly I only had to bring it in 3 times with the same problem and they would replace it. I brought it in at least TEN TIMES before they finally gave up and gave me a new computer, and it was only because I'd made complaints to the BBB and I was throwing an absolute fit in the store. They were sick of me after 2 years of this crap. I was sick of them too.
