It has to be reported too . . .

Initially the laws were meant protect people in case the older person was obviously being harmful versus being sincerely into the other person. Prosecutors have expanded the scope of the laws through application.

Edited to add: Most states have a four year window.

There is a case where the boy was 4 years and ten days older than his girlfriend. High school Senior and Freshman. Her parents didn't like him so they turned him in to the police. That ten days got him 8 years in prison.
