I would just refer back to the Separate but Equal doctrine that we had in this country in the early part of the 20th century. Why didn't that work?
Also, DP benefits do cover, well, probably some of that already, but no one is really required to adhere to it. Like, a company can choose to give benefits to spouses but still exclude domestic partners. No DP at all get federal legal/tax coverage and it still doesn't cover random things (like a lot of car rental companies will only let another person drive without an extra charge if they are your spouse). So, even then it's Separate but Not Equal.
