Well, they would want to question him as a witness even his crew did not return fire. Because he was the target, anything he saw or heard could be relevant and make him a material winess whom they can subpoena or issue a warrant for in order to get him to come in. Also, it does sound as though there is a chance that he or his crew returned fire.
