I don't know about the burden of proof concerning whether the fraternity knew about underage drinking -- but, let's face it, the drinking occurs in every fraternity -- and they all know about it. They just have no real way to stop it.
Does that make them liabel? Guess the court will have to decide, if it comes to that.
In terms of your comment about the lawyers seeing dollar signs -- or course they do.
In terms of "getting the rest of us" if this suit is successful -- of course they will. For the same reasons.
In terms of holding the fraternity responsible for the "lapse in personal judgement" of a couple of members. Well, juries and judges have done dumber things.
That's why I'm worried.
