A new member can choose to drink, but cannot be forced to drink. (And the drinking certainly isn't allowed if they're underaged, of course!)
The definition of hazing really varies a lot from group to group. If you search (click the little search button at the top right hand of the page) I'm sure you can find a thread with a much more detailed answer. Basically, though, it's something a new member is forced to do that an active wouldn't. My organization's policy is very, very strict- scavenger hunts are considered hazing, as well as any sort of exam for new members, or even teasing new mebers about what they will go through for initiation. One of the first thing new members of Kappa are asked to do is read and sign a copy of the Fraternity's hazing policy- both the hazer and the hazee can be held responsible in any hazing incident.
