Agreed. My guess on that one is that the National Fraternity took action more than the school. I don't know what the most you could legally prosecute the chapter on beyond hazing and assault (maybe malicious wounding?). The other problem with taking legal action is that it fails the "giggle test". If the prosecutor has a tough time keeping a straight face in court, conviction gets tough.
