I agree that having old tests and files is reference rather than cheating.
At my school professors will post them online or in the library or even go over them in class as a review before the test. Using old tests is actually recommended by professors. If the new tests are exactly the same or very similar to old tests and people are just memorizing the answers, I think it's the lazy professors fault for not changing the test.
