At that meeting, Buckley spoke before the board of adjustment and mentioned a variance granted in December for a new house for the Beta Theta Pi fraternity, which is being built at College Avenue and Rosemary Lane.

The Beta house construction project caused controversy in recent months. City building inspectors failed to note that the architect had designed the house 7 feet too tall for the property's R-3 zoning. The error wasn't noticed until a frame for the house already had been constructed.

The situation resulted in a cash settlement paid by the architect to the East Campus Neighborhood Association to preclude legal action against the architect and the fraternity.
