Is it up to the fraternity or is it some defined rule that prohibits students from the local CC to pledge at the university?

I'll assume you mean NIC (non-NALFO) groups. Many (if not all) NIC fraternities require you to be an enrolled student at the school the chapter is located at in order to join. I know my organization and the others on my campus require it, so I can't speak for every NIC group, but it would be a safe bet to say all of them require it.
